TASTE MIGF –GENERAL TERMS & CONDITIONS OF PARTICIPATION

Whereas AsiaReach Events Sdn. Bhd. [512637-W] (hereinafter referred to as “the Organiser”) is organising Taste MIGF (hereinafter referred to as either “Taste MIGF” or “the event”) at the Berjaya Times Square Hotel (hereinafter referred to as “the venue”) on 23rd September 2016 from 6pm to 11pm (By invitation only) and on 24th and 25th September 2016 between the hours of 11.00am to 10.00pm, and the Participant is desirous of participating in the event, both parties hereby agree to the following General Terms and Conditions of Participation
 

A. DEFINITIONS

  1. 1. For the purpose of these General Terms and Conditions of Participation the following definitions apply:
    1. ”Taste MIGF” and “the event” refer to the event taking place in the Berjaya Times Square Hotel on the 23rd, 24th and 25th September 2016.
    2. ”the Organiser” refers to AsiaReach Events Sdn. Bhd. (512637-W) and or its employees, designated representatives, appointees and third party contractors and agents.
    3. "the venue" refers to the Berjaya Times Square Hotel
    4. ”the Participant” or ”Participants” refers to any person or persons purchasing Gastro Dollars or attending Taste MIGF at the Berjaya Times Square Hotel during the period of 23rd, 24th and 25th September 2016 inclusive.
    5. ”Workshop” is any activity organised by The Organiser throughout the venue including, but not limited to, cooking demonstrations, cooking classes, wine appreciation, wine classes, cigar appreciation, mixology, talks and other activities.
    6. ”Gastro Dollar” is defined as the currency issued by the Organiser for use in lieu of cash payment by Taste MIGF Participants at part of the venue in the “Theatre of Cuisines” only on the 23rd, 24th and 25th September 2016.
    7. ”Gastro Dollar Voucher” is the voucher given to the Organiser at the venue in exchange for Gastro Dollars. Gastro Dollar Vouchers are either downloaded following an online purchase of Gastro Dollars or given to Participants after the cash purchase of Gastro Dollars from an Authorised Ticketing Agent.
    8. ”Authorised Ticketing Agent” is any person or organisation officially appointed by the Organiser to sell Gastro Dollars

B. THE EVENT

  1. Admission to and participation in the event is subject at all times to the Participant accepting and agreeing to the event’s General Terms and Conditions of Participation as set out herein. In the event the Participant does not comply with the General Terms and Conditions of Participation, the Organiser reserves the right to terminate their participation in the event or to refuse admission to the event without any liability whatsoever to the Organiser.

  2. The Organiser does not act in bias towards nor specifically endorse/recommend any restaurants, exhibitors, vendors, commercial products, processes, or services presented at Taste MIGF. The views and opinions of restaurants, exhibitors, speakers, sponsors and other third parties expressed at the event do not necessarily state or reflect those of the Organiser. Further, the Organiser makes no statements, representations, or warranties about the accuracy, completeness or quality of any goods sold or foodstuffs, materials, products or services presented by the restaurants, exhibitors, vendors, speaker(s), sponsor(s), and Workshop organisers at the event.

  3. It is the responsibility of the Participant to comply, and also to ensure that any children accompanying the Participant comply, with any directions and/or instructions given to them at the event, including without limitation, in regard to conformity with health and safety instructions and all relevant laws, rules and regulations.

  4. The Organiser reserves the right to refuse entry to the event or, without liability, to remove persons deemed to conduct themselves inappropriately or to affect the smooth running of the event. The decision of the Organiser is final and no correspondence shall be entered into. Restrictions may apply to children and will be at the sole discretion of the Organiser.

  5. Taste MIGF may be recorded by the Organiser and the Participant consents to being filmed and recorded during the course of the event. The Participant further grants the Organiser, or its successors any and all rights of whatever kind to use, and to permit others to use, all or any part of recordings of any type made of the Participants appearance at the event in any and all media now known or hereafter devised or invented and by any means throughout the world in perpetuity, and by means of publicity and promotion relating to the event.

  6. No video/photographic or other audio-visual equipment may be used at the event without the express permission of the Organiser. In addition to cameras, these include capabilities such as those found on mobile phones, laptops, MP3 players or similar electronic devices.

  7. The Organiser is not responsible for any delays or failure to perform arising from or attributed to acts, events, missions, interferences, accidents, misprints, editing errors, breakdown of machinery, failure of power, fire, and failure of speakers to make public appearances, restaurant stations running out of food, exhibitors running out of products, or lateness, strikes, weather conditions, dispatch delays, unforeseen hazards and/or other frustrations. The Organiser will also not be liable for any loss or damage or personal injury, or death suffered or sustained in relation to the event. The Participant releases the Organiser from any and all causes of action, losses, liability, damage, expense (including legal expenses) cost or charge suffered, sustained or in any way at the event.

  8. The Organiser reserves the right to amend the contents of these General Terms and Conditions of Participation and to postpone or cancel the event or amend any dates, times and details of the event without giving any reason whatsoever. In the event of the cancellation of the event in its entirety refunds will be made to Gastro Dollar purchasers by the presentation of their Gastro Dollar Exchange form as notified by the Organiser on the official event website together with proof of purchase. Any booking or transaction fees are non-refundable. In the event of cancellation, the Organiser shall not be liable for any loss of enjoyment or wasted expenditure. All personal arrangements including travel, subsistence and accommodation relating to attendance at the event are made at your own risk

C. VALIDITY OF Gastro Dollar VOUCHERS (GDVs)

  1. The purchase and redemption of GDVs is subject at all times to the General Terms and Conditions of Participation as stated herein, and the Participant accepts and agrees to be bound by such terms and conditions.

  2. Any queries relating to these Terms and Conditions should be raised with the Organiser prior to purchase. Purchase of GDVs constitutes acceptance of these Terms and Conditions.

  3. Participants must check their GDVs carefully at the time of purchase and notify the Organiser immediately of any mistake or inconsistency.

  4. GDVs are non-refundable except in the event of cancellation as stated in the Taste MIGF General Terms and Conditions of Participation.

  5. A valid GDV must be produced at the Event for the exchange and redemption of Gastro Dollars. Removing any part of, altering or defacing the GDV may invalidate the Participant’s Gastro Dollars.

  6. GDVs are only exchangeable between the hours of 10am-9pm on 24th and 25th September 2016. GDVs presented after this period will be considered invalid.

  7. GDVs cannot be used for any other purpose other than for the redemption of Gastro Dollars.

  8. Any GDV obtained in breach of these Terms and Conditions shall be void and all rights conferred or evidenced by such GDV shall be void. Any person seeking to use such a void GDV in order to gain or provide entry to the Event may be considered to be a trespasser and may be liable to be ejected and face legal action.

D. Gastro Dollars

  1. The purchase and redemption of Gastro Dollars is subject at all times to the General Terms and Conditions of Participation as stated herein, and the Participant accepts and agrees to be bound by such terms and conditions.

  2. Gastro Dollars are usable as currency in the venue for the following days only, the 24th and 25th September 2016 from 11am to 10pm, according to the day pass purchased. One Gastro Dollar is required for entry to the Theatre of Cuisines. Terms and Conditions apply.
     
  3. Prior to the event Gastro Dollars can be purchased online or in cash from the Organiser or the Organiser’s authorised ticketing agents. As a receipt of purchase a Gastro Dollar Voucher will be given to exchange for Gastro Dollars at the venue Gastro Dollars Station. Gastro Dollars will only be exchanged upon proof of the Purchaser’s identity i.e. credit card number, mobile phone number, IC number or Passport number. In the case of a complimentary ticket or gift, the Participant should present a letter from the original purchaser. The Gastro Dollars Station will open from 10am to 9pm on the 24th and 25th September 2016. Terms and Conditions apply.

  4. Gastro Dollars can also be purchased at the venue in cash throughout the event either from the Gastro Dollars Station or from the Organiser’s authorised Gastro Dollar promoters.

  5. Gastro Dollars once purchased are non-refundable unless there is a cancellation of the event in its entirety. Gastro Dollars are non-transferable, and cannot be exchanged for cash, goods or services beyond those outlined within these Terms and Conditions. Copied, damaged or defaced Gastro Dollars will not be accepted. Lost Gastro Dollars will not be refunded.

  6. Gastro Dollars are redeemable in the following areas in the venue:
    1. At Restaurant Stations in the ‘Theatre of Cuisines‘, between the hours of 11am to 10pm on the 24th and 25th September 2016.
    2. At selected exhibitor stations in the ‘Gourmet Village’ and other designated food and drink outlets in the venue between the hours of 11am and 10pm provided that:
      1. Such redemptions are at the absolute discretion of the exhibitor station or outlet with the provision that exhibitor station or the outlet has first been authorised by the Organiser to accept Gastro Dollars.
      2. The exhibitor station and outlet have the right to refuse acceptance of Gastro Dollars without giving any reason whatsoever to the Participant.
      3. The Participant has ensured that the exhibitor station and food and drink outlet have prior authorisation from the Organiser and that the Participant has seen proof of such authorisation.

         
  7. Gastro Dollars may only be used once and must be presented at the time of the transaction. No change will be given if the purchase value is less than the value of the Gastro Dollar.

  8. Redemption of Gastro Dollars is subject to availability and made on a first come first served basis. The Organiser holds itself non-liable in the event of any restaurants running out of food or closing early or Workshops being filled up to capacity. Participants given complimentary Gastro Dollars by the Organiser, sponsors or other third party acknowledge that such tickets are given on a non-priority basis.
     
  9. Unless express and prior permission has been obtained from the Organiser, no other food and beverage item can be consumed in the Theatre of Cuisines and elsewhere at the event other than that purchased from the Festival Restaurants and Festival Partner pavilions using Gastro Dollars. This restriction includes items purchased in the Gourmet Village which cannot be brought into the Theatre of Cuisines or other areas of the event for consumption.

E. CHILDREN

  1. Children under the age of 16 should be accompanied by the Participant or a responsible adult designated by the Participant at all times and in all locations in the venue. The Participant is responsible for the safety and security of any and all children accompanying them for the entire time they are at the venue and will not in any way hold the Organiser or any exhibitors, workshops, restaurants and others liable with regard to anything untoward happening at the venue.
  2. It is the responsibility of the Participant to comply, and also to ensure that any children accompanying the Participant comply, with any directions and/or instructions given to them, including, without limitation, in regard to conformity with health and safety instructions and all relevant laws, rules and regulations.
     

F. WORKSHOPS

  1. Participation in Workshops is subject at all times to the General Terms and Conditions of Participation as stated herein, and the Participant accepts and agrees to be bound by such terms and conditions.
     
  2. By entering, taking a seat in the audience for, and/or otherwise participating in a Workshop, the Participant consents to being filmed and recorded in the course of such Workshop. The Participant further grants the Organiser its successors and assigns any and all rights of whatever kind to use, and to permit others to use, all or any part of recordings of any type made of the Participant’s appearance in the Workshop in any and all media now known or hereafter devised or invented and by any means throughout the world in perpetuity, and by means of publicity and promotion relating to the Workshop.
     
  3. Entry to Workshops is given on a non-priority, first-come, first-served basis and the Organiser reserves the right to deny entrance to any Participant without giving any reason whatsoever. Furthermore, entry to a specified Workshop is only permitted upon registering for such Workshop at the Workshop entrance, if and when such registration is required, and after payment of the requisite number of Gastro Dollars, if and when such payment is required.

  4. Participants acknowledge that the Organiser reserves the right to vary the date and time of Workshops and that dates and timings are subject to change. The Organiser reserves the right to charge whatever entry fee it likes for each workshop regardless of whether an entry fee has been previously advertised as free or otherwise.
     
  5. Participants who have registered online for Workshops must present themselves at the Workshop entrance no later than 15 minutes before the Workshop commences. The Organiser reserves the right to refuse entry to latecomers and remove Participants from the Workshop if they, or any accompanying children for whom the Participant is responsible for, are deemed to conduct themselves inappropriately or be affecting the smooth-running of the Workshop. Furthermore any failure to comply with any directions or regulations including those specified in Clause D2 above will also result in that Participant not being able to participate further and the forfeiture of all their rights as a Participant in the Workshop. The decision of the Organiser is final and no correspondence will be entered into.
     
  6. No video/photographic or any other audio/image-recording equipment may be used at the Workshop. These include such capabilities found on mobile phones, laptops, MP3 players or any other electrical/electronic devices
     
  7. The Organiser does not act in bias towards nor specifically endorse/recommend any commercial products, processes, or services presented at the said Workshops. The views and opinions of Speakers as well as Sponsors expressed at the Workshops do not necessarily state or reflect those of the Organiser. Further, the Organiser makes no statements, representations, or warranties about the accuracy or completeness of any materials, products or services presented by the Speaker(s) or Sponsor(s) at the Workshops.

  8. The Participant accepts that the Organiser will not be liable for any loss or damage or personal injury suffered or sustained in relation to the Participant’s participation in a Workshop, and releases the Organiser from any and all causes of action, losses, liability, damage, expense (including legal expenses) cost or charge suffered, sustained or in any way.
